Calm Premium Family Plans Terms of Service
The following Calm Premium Family Plans Terms of Service (“Calm Premium Family Terms”) apply to your use of the subscription plan that Calm makes available for families (“Family Plan Subscription”). These Calm Premium Family Terms are in addition to, and not in lieu of, your rights and obligations under the Calm Terms of Service (the “Calm Terms”), and the Calm Terms are incorporated by reference herein. If there is a conflict between these Calm Premium Family Terms and the Calm Terms, the Calm Premium Family Terms will control for that conflict. Capitalized terms not defined in the Calm Premium Family Terms have the meanings assigned to them in the Calm Terms.
We may modify the Calm Premium Family Terms at any time, in our sole discretion. If we do so, we’ll let you know by posting the modified Calm Premium Family Terms on the Site and updating the “Last Updated” date at the top of the modified Calm Premium Family Terms. In some cases, we may also notify you of our changes through other communications. It’s important that you review the Terms whenever we modify them because if you continue to use the Services or Products after we have posted modified Calm Premium Family Terms on the Site and, in certain cases, informed you of our changes through other communications, you are indicating to us that you agree to be bound by the modified Calm Premium Family Terms. If you don’t agree to be bound by the modified Calm Premium Family Terms, then you must cancel your Family Plan Subscription by visiting the Manage Subscription page or by contacting us by email at support@calm.com.
1. Calm Premium Family Plans
A Family Plan Subscription grants the primary account holder and up to five (5) subsidiary account holders access to certain enhanced features of the Services while the Family Plan Subscription is active. Family Plan Subscriptions are for your chosen family, and subsidiary account holders need not be related to the primary account holder. However, Family Plan Subscriptions are currently only available to users residing in Australia and Canada. The primary account holder and all subsidiary account holders must be at least 18 years of age. The Services are not intended to be used by and should not be used by minors without the involvement of a parent or guardian.
2. Primary Family Plan Account
(a) Eligibility and Preexisting Accounts. In addition to the eligibility requirements for the Services provided in the Calm Terms, your eligibility for being a Family Plan Subscription primary account holder depends on your current relationship with Calm.
- New Calm User: If you do not currently have a Calm account, you are eligible to become a Family Plan Subscription primary account holder at any time.
- Existing Web Subscription or Free Trial: If you are currently enrolled in an annual Subscription or free trial that you signed up for on the Calm website, you are eligible to separately pay for and become a Calm Premium Family Plan Subscription primary account holder at any time. If you would like to become a Calm Premium Family Plan Subscription primary account holder and choose not renew your existing annual Subscription, please cancel your annual Subscription’s auto-renewal on the Calm website and you will continue to have access to the existing annual Subscription until its expiration date.
- Existing Third-Party Platform Subscription or Free Trial: If you are currently enrolled in a monthly or annual Subscription or free trial that you signed up for through a third-party platform, including but not limited to the Apple App Store and the Google Play Store, you are eligible to separately pay for and become a Calm Premium Family Plan Subscription primary account holder at any time. If you would like to become a Calm Premium Family Plan Subscription primary account holder and choose not to renew your existing Third-Party Platform Subscription, please cancel your Third Party Platform Subscription’s auto-renewal through the Calm app, which will direct you to your phone’s subscription settings. If you don’t cancel your auto-renewal you will continue to have access to and be charged for the existing Third-Party Platform Subscription until its expiration date.
- Existing Lifetime Subscription: If you are currently enrolled in a lifetime Subscription, you are currently eligible to separately pay for and become a Family Plan Subscription primary account holder.
- Existing Enterprise Subscription: If you are currently enrolled in a Subscription that is paid for by another organization, such as your employer or health care provider, you are eligible to separately pay for and become a Family Plan Subscription primary account holder.
(b) Payment. The primary account holder is responsible for all fees associated with a Calm Premium Family Plan Subscription. Calm Premium Family Plan Subscriptions are made available on a yearly basis (“Subscription Periods”) for the recurring fee indicated at the time you enroll in the Family Plan Subscription (“Subscription Fee”). Your Calm Premium Family Plan Subscription is continuous until you cancel it and that you will be charged the Subscription Fee both (i) when you initially enroll in a Calm Premium Family Plan Subscription and (ii) at the beginning of each subsequent Subscription Period until you cancel. YOU HEREBY AUTHORIZE CALM TO USE THE PAYMENT INFORMATION YOU HAVE PROVIDED TO AUTOMATICALLY CHARGE THE SUBSCRIPTION FEE AT THE BEGINNING OF EACH SUBSCRIPTION PERIOD UNTIL YOU CANCEL YOUR CALM PREMIUM FAMILY PLAN SUBSCRIPTION. Calm gift cards cannot be used as your Payment Information for Calm Premium Family Plan Subscriptions.
The Subscription Fee is not dependent on how many subsidiary accounts are being used in a Family Plan Subscription. All Subscription Fees are fully earned upon payment.
Calm reserves the right to change its pricing terms for Calm Premium Family Plan Subscriptions at any time and Calm will notify you in advance of such changes becoming effective. Changes to the pricing terms will not apply retroactively and will only apply to Subscription Periods after such changed pricing terms have been communicated to you. If you do not agree with the changes to Calm’s pricing terms, then you may choose to cancel your Calm Premium Family Plan Subscription.
(c) Managing a Calm Premium Family Plan. A Calm Premium Family Plan Subscription primary account holder can invite subsidiary account holders to join the Calm Premium Family Plan Subscription by sending them an invitation and subsidiary account holders join the Calm Premium Family Plan Subscription by accepting the invite. If you are under the age of 18, you are not permitted to provide your personal information to Calm and you must be 18 or older to register to join the Family Plan Subscription. If you are a Calm Premium Family Plan Subscription primary account holder and you invite a subsidiary account holder to join your Calm Premium Family Plan Subscription, by doing so you agree to have your identifying information, such as name and email address, shared with the subsidiary account holder. A Calm Premium Family Plan Subscription primary account holder can remove subsidiary accounts from a Calm Premium Family Plan Subscription at any time. Any subsidiary account so removed will immediately no longer have access to the enhanced features of the Services.
(d) Ending a Calm Premium Family Plan. A Calm Premium Family Plan Subscription primary account holder can end a Calm Premium Family Plan Subscription by either canceling the Family Plan Subscription or by converting it into an individual Subscription. You can cancel or convert your Family Plan Subscription at any time by visiting the Manage Subscription page or by contacting us by email at support@calm.com.
If a Family Plan Subscription is canceled, all users on the Family Plan Subscription will no longer have access to the enhanced features of the Services at the end of the Family Plan Subscription’s then-current Subscription Period.
If a Family Plan Subscription is converted into an individual Subscription, subsidiary accounts on the Family Plan Subscription will lose access to the enhanced features of the Services at the end of the Family Plan Subscription’s then-current Subscription Period. The primary account holder will continue to have access to the enhanced features of the Services under an individual Subscription and will be charged in accordance with the terms of their individual Subscription. 3. Subsidiary Family Plan Accounts
(a) Eligibility and Preexisting Accounts. In addition to the eligibility requirements for the Services provided in the Calm Terms, your eligibility for being a Calm Premium Family Plan Subscription subsidiary account holder depends on your current relationship with Calm.
- New Calm User: If you do not currently have a Calm account, you are eligible to become a Calm Premium Family Plan Subscription subsidiary account holder at any time.
- Existing Web Subscription: If you are currently enrolled in an annual Subscription that you signed up for on the Calm website, you are eligible to separately become a Calm Premium Family Plan Subscription subsidiary account holder. If you would like to become a Calm Premium Family Plan Subscription subsidiary account holder and choose not to renew your existing annual Subscription, please cancel your annual Subscription’s auto-renewal on the Calm website and you will continue to have access to the existing annual Subscription until its expiration date.
- Existing Web Free Trial: If you are currently enrolled in a free trial that you signed up for on the Calm website, you are eligible to become a Calm Premium Family Plan Subscription subsidiary account holder at any time.
- Existing Third-Party Platform Subscription or Free Trial: If you are currently enrolled in a monthly or annual Subscription or free trial that you signed up for through a third-party platform, including but not limited to the Apple App Store and the Google Play Store, you are eligible to separately become a Calm Premium Family Plan Subscription subsidiary account holder at any time. If you would like to become a Calm Premium Family Plan Subscription subsidiary account holder and choose not to renew your existing Third-Party Platform Subscription, please cancel your Third Party Platform Subscription’s auto-renewal through the Calm app, which will direct you to your phone’s subscription settings. If you don’t cancel your auto-renewal you will continue to have access to the existing Third-Party Platform Subscription until its expiration date.
- Existing Lifetime Subscription: If you are currently enrolled in a lifetime Subscription, you are currently eligible to separately become a Calm Premium Family Plan Subscription subsidiary account holder.
- Existing Enterprise Subscription: If you are currently enrolled in a Subscription that is paid for by another organization, such as your employer or health care provider, you are eligible to separately become a Calm Premium Family Plan Subscription subsidiary account holder.
(b) Joining a Calm Premium Family Plan. If you join a Calm Premium Family Plan Subscription as a subsidiary account holder, by doing so you agree to have your identifying information, such as name and email address, shared with the primary account holder so that the primary account holder is aware of the subsidiary account holders on the Calm Premium Family Plan Subscription.
(c) Leaving a Calm Premium Family Plan. The primary account holder of a Calm Premium Family Plan Subscription can remove subsidiary accounts from the Calm Premium Family Plan Subscription at any time. If you wish to be removed from a Calm Premium Family Plan Subscription, please either visit the “Manage Subscriptions” section in your Profile to do so or request that the primary account holder remove you. Any subsidiary account so removed will immediately lose access to the enhanced features of the Services.
4. Availability
Calm reserves the right to terminate, modify or suspend Calm Premium Family Plan Subscriptions in whole or in part at any time and for any reason.
